The WTO has ruled that U.S. duties on Canadian supercalendered paper exports incorrectly used the “adverse facts” process. That follows a NAFTA dispute panel completed in April 2017. There are three lessons for the WTO complaints against America’s section 232 duties on metals and the review of autos.
